LICENSE AGREEMENT NOTE: All references to "CacheSentry Pro" apply to and only to version 1.02 of the software. This document does not apply to any other version. NOTE: All references to the "installer file" refer to both the .ZIP archive installation and .msi installation. NOTE: Any references to the "trial version", "evaluation version", or "evaluation installation" are synonymous. They both refer to an installation of CacheSentry Pro that has not been unlocked by a registration key purchased directly from EnigmaticSoftware. PROVISIONS REGARDING THE DISTRIBUTION OF THE EVALUATION VERSION OF CACHESENTRY PRO 1. DISTRUBUTION ON THIRD PARTY WEB/FTP SITES: The evaluation version of a CacheSentry Pro installation file may be included on an FTP or web site provided no monetary charges to persons downloading the software are applied. No permission is required from EnigmaticSoftware to distribute the installation, and no payment to EnigmaticSoftware is required. The installer file must be kept intact and unaltered as it was downloaded from EnigmaticSoftware. 2. DISTRIBUTIONS ON THIRD PARTY CD-ROM: The evaluation version of a CacheSentry Pro installation file may be included on CD-ROM or magazine CD-ROM distributions. No permission is required from EnigmaticSoftware to distribute the installation, and no payment to EnigmaticSoftware is required. The installer file must be kept intact and unaltered as it was downloaded from EnigmaticSoftware. 3. OEMS & SYSTEM MANUFACTURERS PREINSTALLING CACHESENTRY PRO: If you are an individual or business building computer systems for sale on which you wish to include CacheSentry Pro, please contact sales@enigmaticsoftware.com to obtain a special license agreement and mass purchase of registration keys for your buyers if you plan to preinstall the registered version. (A discount may be available depending on the number of keys purchased.) The evaluation version may not be distributed preinstalled on computer systems without receiving a special license agreement from EnigmaticSoftware. However it is permissible to include CacheSentry Pro on such computer systems without any permission or payment to EnigmaticSoftware if it is only the evaluation installation file that is distributed with the computer system being sold. (The user purchasing the computer will be responsible for the installation and purchase of the registration key in such cases.) The installer file must be kept intact and unaltered as it was downloaded from EnigmaticSoftware. 4. Any distribution method not explicitly defined in section 1 through 3 is forbidden unless permission is obtained from Enigmaticsoftware. 5. Under no circumstances may registration keys be included with a distribution of the installation file. PROVISIONS REGARDING AN EVALUATION INSTALLATION OF CACHESENTRY PRO 6. While there is no absolute guarantee of technical support to unregistered users of CacheSentry Pro, some support will likely be available at some level. 7. Once the evaluation version of CacheSentry Pro has been installed, the users of the program on the computer it is installed have approximately 100 days to try out the software. Once this period has expired, the software must be removed from the computer it is installed on and the users of this computer agree to not use the software on this computer until a registration key has been purchased. 8. Once a user has entered a valid registration key (see section 11 regarding the definition of a valid registration key) the installation currently on this computer changes from an "evaluation installion" to a "registered installation". PROVISIONS REGARDING A REGISTERED INSTALLATION OF CACHESENTRY PRO 9. A registration key purchased may be used on only one installation of CacheSentry Pro. Additional keys must be purchased if multiple installations of CacheSentry Pro are to be unlocked. If CacheSentry Pro is to be installed in a business environment or public institution on several computers, please contact sales@enigmaticsoftware.com regarding the purchase of a multi-computer registration key and license. 10. A registered installation is an installation of CacheSentry Pro that has been unlocked with a valid registration key. All users of that computer (in addition to the person who purchased the registration key) are allowed to use CacheSentry Pro as long as the registration key with one (and only one) installation. 11. A "valid registration key" is a key that is purchased directly from EnigmaticSoftware and is accepted by the program where it is checked for validity. 12. No user is allowed to disseminate or transfer ownership of CacheSentry Pro registration keys to any other user without receiving permission from EnigmaticSoftware. 13. Technical support for registered versions of CacheSentry Pro will be given through our support e-mail and/or web site message forum. Proof of registration by the user may be required in some cases in order to receive technical support. EnigmaticSoftware is not responsible for lost or misdirected support questions. PROVISIONS REGARDING THE USE OF BOTH THE EVALUATION INSTALLATION AND REGISTERED INSTALLATION OF CACHESENTRY PRO: 14. All copyrights to CacheSentry Pro are exclusively owned by EnigmaticSoftware and/or it's author, David Pochron. 15. CACHESENTRY PRO IS DISTRIBUTED "AS IS". NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE CACHESENTRY PRO AT YOUR OWN RISK. ENIGMATICSOFTWARE, CACHESENTRY PRO'S AUTHOR(S), NOR ANY OF ENIGMATICSOFTWARE'S EMPLOYEES WILL BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS FROM THE USE OR MISUSE OF THIS SOFTWARE. 16. You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble or otherwise reverse engineer, transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution. 17. All rights not expressly granted here are reserved by EnigmaticSoftware and/or the author of CacheSentry Pro, David Pochron. 18. The terms of this license, as well as the CacheSentry Pro features and interface design are subject to change in future versions. Any changes to future license agreements supersede the conditions and provisions set in this license agreement. 19. If there is any failure to comply with the terms of this license, the license is automatically and immediately terminated. In any case where the license agreement is terminated or is not agreed upon, the installation immediately becomes "unlicensed". At this point, depending on the type of user you are, you must follow these steps: a. INSTALLER: If you are responsible for the installation of CacheSentry Pro, any such unlicensed installations on those computer systems must be removed. If there are registration keys on the computer system they must be deleted. b. USER: If you are a user of any computer which has CacheSentry Pro installed and either do not agree with this license or are using an unlicensed version of the program, you must stop using CacheSentry Pro on any such computers. 20. Your agreement to this license is expressed by the use and/or installation of CacheSentry Pro.
